Previously, there was a distinction between attorneys and advocates. Attorneys engaged members of the public directly and thereafter consulted advocates (depending on the complexity of the matter). Advocates could not engage directly with members of the public.
With the advent of the Legal Practice Act 28 of 2014, a new category of advocates was added.
Advocates can now, in terms of Section 34(2)(a)(ii) practice with a Fidelity Fund certificate and engage members of the public directly. This type of advocate is colloquially referred to as a “Trust Account advocate” and eliminates the need for an attorney. Adv K P Mputle practices with a Fidelity Fund certificate under the direct supervision of the Legal Practice Council.
The benefit of engaging a Trust account advocate directly is that there is a reduction of fees and direct access to a more skilled legal practitioner among other benefits.
